Waiver

The whole point of an excursion on a luxury yacht is to have fun. Safely! To make sure that happens there are some rules that you and your guests will have to become familiar with and follow. The failure to follow these rules can only have one result, which is a return to dock, and that definitely is NOT fun.

 

1. Captain’s Rules – The most important rule is to follow all directions of the Captain and crew. Explicitly. They have extensive training and experience, and that has to be respected. Weather, mechanicals, other boats and dumb people can present unpredictable circumstances that no amount of planning can avoid. When those exigencies arise, the Captain is required to make game-time decisions to keep you and the boat safe, and it is absolutely mandatory that their decisions and directions are followed.

2. Illegal Drugs – The Coast Guard also has no tolerance for illegal drugs on excursion yachts. Medical marijuana is legalized by the state, but surprisingly, the federal government still considers it contraband and therefore we cannot have it on board. Please plan your dosing schedule around our departure and return times to avoid any problems.

3. Drinking – Drinking onboard is not against anybody’s rules, thank goodness. However, it is important that no guest become so intoxicated that they become a danger to themselves or others. Boats rock and roll unexpectedly, making intoxication dangerous. If you believe anyone is approaching the level of dangerous intoxication, please alert a crew member if you need help asking them to limit their intake, and similarly if called upon by a crew member to stop a guest’s intake, it will be your responsibility to ensure that it happens.

4. Beverage Restrictions – Our ticket price does not include or otherwise contemplate alcoholic beverages. Please feel free to bring alcoholic beverages onboard, especially beer, white wine, and hard seltzers. Red wine is prohibited onboard, as it stains terribly. Hard liquor is also prohibited for the time being. Let’s keep it classy!

5. Damage to the Yacht – You are, of course, financially responsible for any damage caused to the vessel or its equipment by you or your guests. If we contend there is such damage, we will, within 48 hours of the end of your excursion advise you of the claim and as soon as possible deliver to you evidence of the claim and an estimate of the cost. Your damage deposit will be used as the first source to pay the damages but is not a limitation of your liability.

6. Cancellation – You may request a full refund with at least 24hrs notice. Within 24hrs, tickets will only be refunded if your cruise is cancelled due to weather (sustained winds over 20mph or lightning within 7 miles) or mechanical concerns.

7. Aerosols – Please ask your guests NOT to bring aerosol sunscreen on board. That is terribly harmful to the teak deck and other equipment that we work hard to maintain in top condition.

8. Shoes – We ask that all guests remove their shoes as they board. We will stow all shoes onboard during the charter and lay them out for recollection after the charter. You are welcome to wear socks onboard, and we can make an exception for brand new, right-out-of-the box soft shoes like Crocs or ballet flats if needed.
